The Office of Critical Minerals and Energy Innovation (formerly the Office of Energy Efficiency and Renewable Energy) of the Department of Energy (DOE) has reviewed the petroleum-equivalency factor (PEF) for electric vehicles (EVs) used by the Environmental Protection Agency (EPA) in calculating light-duty vehicle manufacturers' compliance with the Department of Transportation's (DOT) Corporate Average Fuel Economy (CAFE) standards. DOE has determined that revisions to the PEF are necessary. DOE is first publishing a final rule that removes the fuel content factor (FCF) from the calculation of the PEF. Removal of the FCF is consistent with a United States Court of Appeals for the Eighth Circuit decision that held, among other things, that the inclusion of the FCF in the PEF calculation exceeded DOE's authority under the substantive statute. This interim final rule substantially revises Department of Energy's (DOE) regulations containing its National Environmental Policy Act (NEPA) implementing procedures, which were promulgated to supplement now-rescinded Council on Environmental Quality regulations. Mindful that the Supreme Court recently clarified NEPA is a "purely procedural statute," DOE will henceforth maintain the remainder of its procedures in a procedural guidance document separate from the Code of Federal Regulations (DOE NEPA implementing procedures). Thus, DOE is revising 10 CFR part 1021 to contain only administrative and routine actions excepted from NEPA review in appendix A, its existing categorical exclusions in appendix B, related requirements, and a provision for emergency circumstances. DOE is revising appendix A in 10 CFR part 1021 to align with DOE's new NEPA implementing procedures that it is publishing separate from the Code of Federal Regulations. Appendix A in 10 CFR part 1021 (formerly categorical exclusions) are now administrative and routine actions that do not require NEPA review. DOE is also revising 10 CFR part 205, subpart W, to remove the NEPA procedures from its Presidential permit regulations.

On September 11, 2024, the Department of Energy ("DOE") received a petition from Dyson Inc. for DOE to revoke the procedures by which manufacturers must measure and represent to consumers the effective room size coverage and integrated energy factor of their air cleaner products. If the provisions are not revoked, Dyson Inc. requested that DOE stay enforcement of these provisions pending a new notice and comment period regarding potential amendments to these provisions. DOE is not revoking or staying enforcement of the test procedure and representations provisions raised in Dyson's petition at this time. Through this notification, DOE is seeking views on whether it should grant the petition and undertake a rulemaking to consider the proposal contained in the petition, as well as any data or information that could be used in DOE's determination whether to grant the petition.

The U.S. Department of Energy (DOE) is publishing a notice of proposed rulemaking to amend the compliance date for its manufactured housing energy conservation standards. Currently, manufacturers must comply with these standards on and after July 1, 2025, for Tier 2 homes and 60 days after the issuance of enforcement procedures for Tier 1 homes. DOE is proposing to delay the Tier 2 compliance date to allow DOE more time to consider the proposed enforcement procedures and comments submitted, and to evaluate appropriate next steps that provide clarity for manufacturers and other stakeholders.

As a result of this review, DOE is proposing to withdraw its prior determination that miscellaneous gas products ("MGPs"), which are comprised of decorative hearths and outdoor heaters, qualify as covered products under Part A of Title III of the Energy Policy and Conservation Act, as amended ("EPCA"). After further consideration of the relevant statutory authority and available information, DOE is proposing to withdraw its determination that MGPs are covered products under EPCA for which DOE is authorized to establish test procedures and energy conservation standards.

The Department of Energy (DOE or the Department) is issuing this interim final rule (IFR) to update, streamline, and relocate the policies, procedures, and provisions that are applicable to the award and administration of certain other transaction (OT) agreements awarded under DOE's OT authority provided in the Energy Policy Act of 2005's amendments to the Department of Energy Organization Act. DOE expects that the simplification of the implementing regulations will enable improved use OT Agreements beyond the Technology Investment Agreements (TIAs) contemplated in the original regulations. The Federal Energy Regulatory Commission amends its regulations implementing the National Environmental Policy Act (NEPA) to expand an existing Categorical Exclusion (CE) to include "terminations or revocations of water power licenses and exemptions that will result in minor or no ground disturbing activity and minor or no changes in reservoir conditions and downstream flows."
The U.S. Department of Energy ("DOE") is adopting the interim final rule published on August 25, 2025, as final, without change. This final rule establishes the procedures for developing and carrying out voluntary agreements and plans of action under the Defense Production Act. The Defense Production Act provides a defense from antitrust laws with respect to any action taken to develop or carry out any voluntary agreement or plan of action when certain criteria are met.
The Department of Energy (DOE or Department) is amending its Financial Assistance Regulations to establish conflict of interest and conflict of commitment policies and requirements for non-Federal entities applying for or receiving financial assistance awards from the Department, and to implement and standardize certain disclosure requirements applicable to financial assistance applications and awards, including responsibilities, general rules, and procedures for non-Federal entities to identify, evaluate, resolve, and report conflicts of interest, conflicts of commitment, and organizational conflicts of interest, in financial assistance applications and awards.
DOE publishes this final rule to revise its regulations issued under the Program Fraud Civil Remedies Act of 1986 ("PFCRA"), amended by the Administrative False Claims Act of 2023 ("the AFCA"). The AFCA, formerly PFCRA, pertains to the Federal Government's ability to combat fraud involving Federal funds by allowing for the imposition of civil penalties and assessments against persons who make, submit, or present, or cause to be made, submitted, or presented, false, fictitious, or fraudulent claims or written statements to the government. The final rule updates DOE regulations to reflect recent amendments to the statute. The updates reflect the new title; increase the maximum amount for claims from $150,000 to $1 million; allow for reverse false claims; define new terms; extend the statute of limitations for bringing claims; require DOE to notify the Attorney General before settlement of allegations; and establish a process for crediting recovered costs. Under the statute, the heads of executive agencies, including the Secretary of Energy, are required to promulgate regulations and procedures to carry out the statute. The statute also requires the heads of executive agencies to review and update existing agency regulations to ensure compliance with the AFCA.

On April 13, 2026, the Secretary of Energy ("Secretary") issued a Determination generally authorizing the destination of Thailand for exports of controlled nuclear technology and assistance under DOE's regulation on Assistance to Foreign Atomic Energy Activities. Accordingly, DOE is issuing this final rule to add Thailand to the generally authorized destinations list in appendix A.
