Enterprise Duty To Serve Underserved Markets

The Federal Housing Finance Agency (FHFA or Agency) proposes to rescind its regulation on Duty to Serve Underserved Markets and replace it with a new rule. If adopted as proposed, the new rule would enable the Federal National Mortgage Association (Fannie Mae) and the Federal Home Loan Mortgage Corporation (Freddie Mac) (collectively, the Enterprises) to better serve the needs of very low-, low-, and moderate-income families in the manufactured housing, affordable housing preservation, and rural housing markets through greater innovation and with less administrative burden.

2026-2028 Enterprise Housing Goals

The Federal Housing Finance Agency (FHFA) is issuing a proposed rule and requesting comments on the housing goals for Fannie Mae and Freddie Mac (the Enterprises) for 2026 through 2028 as required by the Federal Housing Enterprises Financial Safety and Soundness Act of 1992. The proposed rule establishes benchmark levels for the housing goals for 2026 through 2028. The proposed rule replaces the two area- based subgoals with one low-income areas subgoal, simplifies the goal determination process, clarifies inflation adjustments to maximum civil money penalties related to housing goals, and makes other technical changes.

Financial Data Transparency Act Joint Data Standards

The OCC, Board, FDIC, NCUA, CFPB, FHFA, CFTC, SEC, and Treasury are publishing a final joint rule to establish data standards to promote interoperability of financial regulatory data across these agencies. The standards established pursuant to this joint rule will later be considered for potential incorporation (to the extent feasible) into data standards to be adopted for certain collections of information in separate rulemakings by the agencies or through other actions taken by the agencies. At the effective date, the joint rule will not change any reporting requirements without further action by the agencies. The agencies are publishing this joint rule as required by the Financial Data Transparency Act of 2022.

The Federal Housing Finance Agency published a Final Rule; Technical Amendment document in the Federal Register on March 17, 2026, regarding Correcting Amendment Reinstating "Grandfather" Exceptions to Restrictions on Private Transfer Fee Covenants. The ACTION: line of the Final Rule; Technical Amendment document incorrectly stated that the Final Rule was requesting public comments, however, the Final Rule; Technical Amendment document is not requesting public comments. This correction removes "request for comments" from the ACTION: line of the Final Rule; Technical Amendment document.

Amendment Reinstating “Grandfather” Exceptions to Restrictions on Private Transfer Fee Covenants

The Federal Housing Finance Agency (FHFA) is making a technical amendment to its Private Transfer Fee Covenants (PTFC) Regulation. The PTFC Regulation restricts FHFA's regulated entities-- the Federal National Mortgage Association (Fannie Mae), the Federal Home Loan Mortgage Corporation (Freddie Mac) (collectively, the Enterprises), and the Federal Home Loan Banks (Banks)--from purchasing, investing in, accepting as collateral, or otherwise dealing in mortgages on properties encumbered by certain types of PTFCs, or related securities, subject to certain exceptions. The technical amendment reinstates timing and transitional applicability ("grandfather") exceptions that were removed by FHFA's 2024 amendments to the PTFC Regulation. The reinstated "grandfather" exceptions are applicable nunc pro tunc beginning July 16, 2012.

The Federal Housing Finance Agency (FHFA) is adopting this final rule amending its Rules of Practice and Procedure and other agency regulations to adjust each civil money penalty within its jurisdiction to account for inflation, pursuant to the Federal Civil Penalties Inflation Adjustment Act of 1990, as amended by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015.
