Modernizing Package Certification Requirements

The U.S. Nuclear Regulatory Commission (NRC) is proposing to amend its regulations governing the packaging and transportation of radioactive material. This proposed action is responsive to several executive orders and the NRC's mission to enable the safe and secure use of nuclear materials in an efficient and reliable manner. The proposed amendments would establish voluntary provisions to provide greater flexibility for applicants by introducing risk-informed methodologies for demonstrating safety requirements and by providing an alternative radiation standard for approval of Type B packages for certain exclusive use shipments. The proposed rule would streamline application processes for package approval, remove unnecessary requirements, and clarify existing provisions.

Reducing Barriers to Medical Use Licensing

The U.S. Nuclear Regulatory Commission (NRC) is proposing to amend its regulations to reduce barriers to medical use licensing. This proposed rule responds to Executive Order 14300, "Ordering the Reform of the Nuclear Regulatory Commission," which requires the NRC to conduct a review and wholesale revision of its regulations. This proposed rule, if adopted, would reduce overly prescriptive regulations, increase flexibility, and modernize radiation safety practices for the medical use of byproduct material. It also would enable more efficient and predictable licensing for emerging medical technologies and reduce unnecessary burden in training and experience requirements for medical authorized users. The NRC is revising guidance for this proposed rule. This proposed rule also would incorporate minor editorial corrections.

Modernizing Reactor Licensing, Safety Oversight, and Siting Practices

Consistent with Executive Order 14300, "Ordering the Reform of the Nuclear Regulatory Commission," the U.S. Nuclear Regulatory Commission (NRC) is conducting a review and wholesale revision of its regulations. This proposed rule aims to modernize reactor licensing, safety oversight, and siting practices addressing sections 5(f), 5(h), and 5(i) of Executive Order 14300, and additional items that contribute to adding additional generation to the electrical grid. Additionally, as part of the NRC's overarching review of all of its regulations, the agency identified a number of further changes to the NRC's regulations that will improve the efficiency and efficacy of its licensing process that are also included in this rulemaking.

Reforming and Modernizing the NRC's Radiation Protection Framework

The U.S. Nuclear Regulatory Commission (NRC) is proposing to amend its regulations that govern its standards for protection against radiation. These proposed revisions would address section 5(b) of Executive Order 14300, "Ordering the Reform of the Nuclear Regulatory Commission," and would reflect the NRC's experience and other developments in the field of radiation protection since the NRC's last major revisions to these standards in 1991. In addition, the NRC is issuing for public comment draft implementing guidance.

Implementation of the National Environmental Policy Act

The U.S. Nuclear Regulatory Commission (NRC) is proposing to revise the NRC's regulations to streamline and modernize its implementation of the National Environmental Policy Act of 1969, as amended (NEPA). These proposed revisions address Presidential directives in Executive Order (E.O.) 14300, "Ordering the Reform of the Nuclear Regulatory Commission," E.O. 14154, "Unleashing American Energy," Executive Order 14192, "Unleashing Prosperity Through Deregulation," Executive Order 14270, "Zero-Based Regulatory Budgeting to Unleash American Energy;" recent amendments to NEPA; and relevant NEPA case law. In addition, these proposed revisions aim to reduce regulatory burden while complying with NEPA requirements. The proposed rule would narrow the scope of NEPA reviews to effects (or impacts) within the NRC's substantive statutory authority; revise definitions; update procedures for determining the level of NEPA review; establish new categorical exclusions; provide new flexibility for licensees, applicants, and petitioners for rulemaking to submit environmental information; and remove outdated requirements and consolidate content provisions to improve clarity and efficiency. Consistent with section 102(2)(B) of NEPA and E.O. 14300, the NRC consulted with the Council on Environmental Quality (CEQ) during the development of this proposed rule. The NRC is issuing new draft guidance NUREG-2270, "Environmental Review Guidance for U.S. Nuclear Regulatory Commission Actions," for the implementation of the proposed requirements in this rulemaking. The NRC staff will carry out its NEPA responsibilities consistent with the proposed requirements in this rulemaking and the guidance in NUREG-2270.

Integrated Low-Level Radioactive Waste Disposal

The U.S. Nuclear Regulatory Commission (NRC) is proposing to amend its regulations that govern the land disposal of low-level radioactive waste to expand regulatory coverage to include certain transuranic wastes. The rule also introduces a new risk-informed framework for low-level waste disposal in which sites can develop waste acceptance criteria based on site-specific characteristics rather than using prescriptive limits. The proposed rule would allow for a graded approach: facilities that do not plan to accept significant quantities of long-lived radionuclides or Greater-Than-Class C waste will only need to meet a streamlined set of requirements, while those managing these waste streams must conduct technical assessments to ensure long- term safety. The proposed rule would also introduce new options for disposal of higher concentrations of waste, providing new alternatives for safe low-level waste management. These innovations support public health and environmental protection, as well as safe disposal of low- level radioactive waste, encourage operational efficiency, and offer greater flexibility for both current and future disposal facilities. In addition, the NRC is issuing draft implementing guidance for public comment.

Modernizing Materials Licensing

The U.S. Nuclear Regulatory Commission (NRC) is proposing to amend its regulations for byproduct, source, and special nuclear material to modernize the NRC's materials licensing requirements. This proposed action is responsive to several executive orders and the NRC's mission to enable safe, efficient, and reliable licensing. These changes are deregulatory in nature and include streamlining the process for existing and certain new applicants to enable bringing power to the grid. Unnecessary regulations are being eliminated, and reporting and recordkeeping requirements are being changed. The NRC is proposing several other changes to clarify regulations that are confusing or ambiguous to make the overall licensing process more efficient. Finally, regulations governing the storage of radioactive material are being amended to accommodate new and advanced nuclear fuels.

Regulation for Federal Financial Assistance

The Office of Management and Budget (OMB) proposes to revise the Guidance for Federal Financial Assistance to improve government- wide policies and requirements related to the management of grants, cooperative agreements, and other forms of assistance. OMB is proposing revisions that would improve transparency, accountability, and oversight for Federal awards across the Federal Government. This includes ensuring that American tax dollars are not wasted or misused, activities performed under Federal awards are consistent with law and policy, and recipients are held accountable when they fail to meet relevant standards. The revisions also aim to ensure that basic American principles of equality and equal opportunity are upheld throughout all stages of the award making process and that unlawful discrimination is no longer permitted. Proposed changes also include providing further clarification on the regulatory status of the OMB requirements and on the process for future updates to the government- wide requirements. Finally, OMB also proposes changes to reduce recipient burden. The listed Federal grant-making agencies propose conforming changes to their respective adopting regulations, or, in the case of some agencies and other entities, establishing new adopting regulations or policies. The proposed changes reflect the administration's commitment to transparency, accountability, and proper oversight for the Federal grantmaking process. The proposed regulations seek to ensure that American tax dollars are ultimately used to serve the needs of the American public.

Modernizing NRC Regulations for Byproduct Material Use

The U.S. Nuclear Regulatory Commission (NRC) is proposing to amend its regulations for the licensing of byproduct material, some source material, and some special nuclear material. The NRC's goal in amending these regulations is to modernize the safe, effective, and efficient use of licensed material. This action would reduce the burden of the NRC's licensing process, eliminate the need for certain exemptions from existing regulations, and eliminate unnecessary requirements. Fee Schedules; Fee Recovery for Fiscal Year 2026

The U.S. Nuclear Regulatory Commission (NRC) is proposing to amend the licensing, inspection, special project, and annual fees charged to its applicants and licensees. The proposed amendments are necessary to comply with the Nuclear Energy Innovation and Modernization Act, which requires the NRC to recover, to the maximum extent practicable, approximately 100 percent of its annual budget less certain amounts excluded from this fee recovery requirement. In addition, the NRC is proposing amendments to establish fixed caps on service fees to implement section 5(a) of Executive Order 14300, "Ordering the Reform of the Nuclear Regulatory Commission." The proposed fixed fee caps implementing Executive Order 14300 would drive increased efficiency and accountability in the NRC's licensing activities and other activities requested by applicants and licensees.

Approval of the 2023 Edition of the American Society of Mechanical Engineers Boiler and Pressure Vessel Code and Code Cases, Revision 41

The U.S. Nuclear Regulatory Commission (NRC) is proposing to amend its regulations to incorporate by reference the 2023 Edition of the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code. This action is in accordance with the NRC's policy to periodically update the regulations to incorporate by reference new editions of the ASME Codes and is intended to maintain the safety of nuclear power plants and to make NRC activities more effective and efficient. The NRC also is proposing to amend its regulations to incorporate by reference proposed revisions of three regulatory guides, which would approve new, revised, and reaffirmed code cases published by the ASME. This proposed action would allow nuclear power plant licensees and applicants to use the code cases listed in these draft regulatory guides as voluntary alternatives to engineering standards for the construction, inservice inspection, and inservice testing of nuclear power plant components. This proposed rule also incorporates minor editorial corrections. The NRC is requesting comments on this proposed rule, on the draft versions of three regulatory guides, and the draft version of an additional regulatory guide which will not be incorporated by reference.

Regulatory Framework for Fusion Machines

The U.S. Nuclear Regulatory Commission (NRC) is proposing to amend its regulations to augment the existing byproduct material framework to be inclusive of fusion machines. The NRC is proposing requirements that are technology-inclusive to accommodate the wide variety of anticipated fusion machine designs across the National Materials Program. The NRC is also issuing for comment draft guidance for the implementation of this proposed rule, entitled NUREG-1556, Volume 22, "Consolidated Guidance About Materials Licenses: Program- Specific Guidance About Fusion Machine Licenses." The NRC will conduct at least one public meeting to promote full understanding of the proposed rule and to facilitate public comments. We seek comment on all aspects of this proposed rule.

Incorporation by Reference of Institute of Electrical and Electronics Engineers Standard 603-2018

The U.S. Nuclear Regulatory Commission (NRC) is proposing to amend its regulations to incorporate by reference the Institute of Electrical and Electronics Engineers (IEEE) Standard (Std) 603-2018, "IEEE Standard Criteria for Safety Systems for Nuclear Power Generating Stations." The IEEE Std 603-2018 is the most recent version of IEEE Std 603 that addresses the power, instrumentation, and control safety systems for nuclear power reactors. This amendment also incorporates editorial changes that do not change the technical information. Generic Environmental Impact Statement for Licensing of New Nuclear Reactors

The U.S. Nuclear Regulatory Commission (NRC) is amending its regulations that govern the NRC's environmental reviews of new nuclear reactor applications under the National Environmental Policy Act. The rulemaking codifies the generic findings of the NRC's Generic Environmental Impact Statement for Licensing of New Nuclear Reactors. The Generic Environmental Impact Statement for Licensing of New Nuclear Reactors uses a technology-neutral framework and a set of plant and site parameters to determine which potential environmental impacts would be common to the construction, operation, and decommissioning of many new nuclear reactors, and thus appropriate for a generic analysis, and which potential environmental impacts would be unique, and thus require a project-specific analysis. The NRC is also issuing revision 4 to regulatory guide 4.2, "Preparation of Environmental Reports for Nuclear Power Stations," and COL-ISG-030, "Environmental Considerations Associated with New Nuclear Reactor Applications that Reference the Generic Environmental Impact Statement (NUREG-2249)." The final rule contained minor errors in grammar, punctuation, and referencing. This document corrects the final rule by revising the sections that contain these errors.
