Civil Monetary Penalty Inflation Adjustment

The Railroad Retirement Board amends its regulations to remove provisions purporting to set and adjust civil monetary penalties assessed under the False Claims Act. The amendment also removes obsolete language relating to a one-time catch-up inflation adjustment that was completed in 2016 and changes references to the Program Fraud Civil Remedies Act to refer to the Administrative False Claims Act.

Eligibility for an Annuity and Family Relationships

The Railroad Retirement Board amends its regulations to remove facially unlawful provisions that define when the spouse, divorced spouse, surviving divorced spouse, or remarried widow(er) of a railroad employee may receive an annuity under the Railroad Retirement Act for having the employee's minor child in care. As currently written, the regulations treat male spouses less favorably than female spouses by terminating annuity entitlement when the child turns age 16 instead of age 18 as for female spouses. If enforced, this disparity would violate the right to equal protection secured by the Due Process Clause of the Fifth Amendment to the United States Constitution.

Regulations Under the Administrative False Claims Act

The Railroad Retirement Board amends its regulations to implement statutory amendments to the Administrative False Claims Act. These amendments revise and remove procedures under the Administrative False Claims Act that are no longer applicable due to statutory changes and implement new procedures allowing administrative false claims to be referred to the Civilian Board of Contract Appeals for adjudication.

Annuity Beginning and Ending Dates

The Railroad Retirement Board amends its regulations to remove limitations on the beginning date of an employee annuity under the Railroad Retirement Act based on attaining age 60 with 30 years of railroad service. As currently written, the regulation requires a claimant to accept a reduced monthly benefit in order to begin the annuity on the first day of the first full month in which the claimant attains age 60. This requirement is no longer consistent with the statutory criteria in the Railroad Retirement Act for the earliest annuity beginning date permitted by law and is therefore facially unlawful.

Evidence of Disability

The Railroad Retirement Board (RRB) amends its regulations to designate additional acceptable medical sources in disability claims under the Railroad Retirement Act. This change recognizes the evolution of how medical care and treatment are delivered and aligns the RRB's acceptable medical sources with recently amended regulations of the Social Security Administration (SSA). Additionally, the changes clarify existing RRB policy regarding how evidence from medical sources, other than those designated as acceptable medical sources, will be evaluated.
